We are a fence company in Simpsonville, SC, and most of what we build here goes into a subdivision with a covenant attached. Simpsonville counted 23,354 residents at the 2020 census, up from 18,238 in 2010, and the neighboring Five Forks community grew from 8,064 people in 2000 to 17,737 in 2020. That growth arrived as platted subdivisions rather than scattered building, which is the single most important thing to understand about fencing here.

The town itself is older than the growth suggests. It was incorporated on 13 August 1901, and before that it was a crossroads where the Old Stage Road met the Georgia Road, with a post office called Plain from 1838 until the name changed in 1886. A subdivision town, and what that does to a fence quote

Simpsonville's residential map is a set of large planned neighborhoods. Neely Farm, at Harrison Bridge Road and Neely Ferry Road, runs to more than 700 homes on its own. Holly Tree Plantation is built around a golf course. Kilgore Farms and the newer developments off Fairview and Scuffletown Roads follow the same pattern: one builder, a handful of elevations, uniform setbacks and a recorded set of covenants.

That uniformity cuts both ways. It helps, because the lots are flat, the lines are square, the corner pins are usually findable and a standard back yard enclosure goes in quickly and predictably. It limits you, because you do not get a free choice. Most Simpsonville covenants name the material, cap the height at six feet, require the fence to start behind the rear corner of the house and require written approval before anything is installed.

Graded lots, swales and the line you cannot block

A subdivision lot is not natural ground. The topsoil was stripped, the pad was cut and filled to drain, and what is left under your grass is compacted Cecil clay with a thin layer of sod over it. Cecil is the dominant Piedmont soil, kaolinite heavy, low shrink swell, and slow to drain on its own. On a graded lot it is slower still, because compaction closed what little structure the clay had.

A post set in a hole that holds water rots at grade, which is why we set to depth for wind load and saturated clay rather than to a frost line that barely exists here.

A privacy fence dropped straight across that swale becomes a dam, and the first heavy storm puts water where it was never meant to go. Will my Simpsonville HOA let me put up a fence?

Almost always yes, but on their terms. Can I put my fence across the drainage swale in my back yard?

Not solidly, and often not at all if the swale sits inside a recorded drainage easement. Those low lines carry stormwater from several lots, and a six foot privacy fence set tight to the ground across one acts as a dam. The water backs up, finds the next low point, and ends up somewhere it was never designed to go.

There are two workable answers. Leave a measured gap under the fence at the low point, sized so water passes and a dog does not, or step the fence and carry it over the swale on a raised bottom rail. We pick the one that fits the yard on the walk, and if the easement forbids a fence in that strip at all, we move the line rather than hide the problem.
